Scope of Practice Disclosure
Purpose and Scope of Services
The Client acknowledges and agrees that the Practitioner provides wellness-oriented and educational services only. The Practitioner does not diagnose, treat, cure, or prevent any disease, disorder, or medical condition, and does not provide medical advice, psychotherapy, physical therapy, nursing care, or any other licensed health care service unless expressly and lawfully authorized to do so in writing and under applicable law.
The services contemplated by this Agreement are intended to support the Client's general well-being and self-care, with a particular focus on women seeking support for hormonal and reproductive health concerns. Such services may include, as appropriate, individualized consultations, wellness education, lifestyle and nutrition discussions, and the preparation of personalized herbal supplement formulas based on information provided by the Client and the Practitioner's professional judgment within the scope of practice permitted by law.
The Client understands that any herbal supplement formulas, recommendations, educational materials, or related guidance are provided for informational and wellness purposes only and are not a substitute for evaluation, diagnosis, or treatment by a physician or other qualified health care professional. The Client is encouraged to consult with a licensed health care provider regarding any symptoms, medical conditions, medications, pregnancy, fertility concerns, reproductive health issues, or other matters that may require medical supervision.
The Practitioner may decline to provide or may modify any service, recommendation, or formula if, in the Practitioner's judgment, the Client's circumstances fall outside the Practitioner's scope of practice, present a potential safety concern, or require referral to a licensed health care provider. The Client remains solely responsible for seeking appropriate medical care and for disclosing accurate, complete, and current information relevant to the services provided.
Nothing in this Agreement shall be construed to create a physician-patient, therapist-client, or other licensed professional relationship, or to authorize the Practitioner to practice beyond the scope permitted under applicable law.
Practitioner Status and Credentials
The Practitioner represents and warrants that the Practitioner is not a licensed physician unless expressly stated otherwise in a written addendum signed by the parties. The Practitioner provides wellness-oriented and educational services only, and not medical diagnosis, treatment, or the practice of medicine unless the Practitioner is separately and expressly authorized to do so under applicable law.
The Practitioner further represents that the services contemplated under this Agreement may be provided by a licensed Traditional Chinese Medicine practitioner, including by video consultation where permitted by applicable law. If services are provided by such practitioner, the Practitioner shall disclose the nature of the practitioner's licensure, training, and credentials to the Client in a manner reasonably sufficient for informed consent.
The Client acknowledges and agrees that any reference to the Practitioner's credentials is intended solely to describe the Practitioner's qualifications to provide wellness-oriented and educational services and does not constitute a representation that the Practitioner is acting as a physician, surgeon, or other licensed medical doctor unless expressly stated in writing. The Client further acknowledges that any video consultation is subject to technological limitations and may not be appropriate for all circumstances.
The Practitioner shall not hold out the services as a substitute for medical care, emergency care, or diagnosis by a licensed healthcare professional, and the Client is encouraged to seek appropriate medical advice for any condition that may require evaluation or treatment by a licensed physician or other qualified healthcare provider.
No Diagnosis or Treatment of Disease
The Client acknowledges and agrees that the Practitioner provides wellness-oriented and educational services only and does not, and shall not be construed to, diagnose, treat, cure, mitigate, or prevent any disease, disorder, illness, injury, or other medical condition.
The Client further acknowledges and agrees that the Practitioner does not provide medical advice, medical care, medical diagnosis, medical treatment, or any service that requires licensure or authorization as a health care provider under applicable law, except to the extent the Practitioner is separately licensed or otherwise expressly authorized to provide such services and clearly states otherwise in writing.
Nothing in this Agreement, any communication between the parties, or any service provided by the Practitioner shall be interpreted as a substitute for professional medical advice, diagnosis, or treatment from a physician or other qualified health care provider. The Client is solely responsible for consulting with an appropriate licensed health care professional regarding any medical concerns, symptoms, conditions, medications, or treatment decisions.
The Client represents that the Client will not disregard, delay, or discontinue seeking medical advice or treatment based on any information, recommendation, or educational content provided by the Practitioner. If the Client has or suspects a medical emergency or serious health condition, the Client shall immediately contact emergency services or a qualified health care provider.
To the extent the Practitioner is a Traditional Chinese Medicine practitioner or otherwise provides services within a recognized scope of practice, the Practitioner shall provide only those services lawfully permitted under applicable law and shall not represent that such services constitute diagnosis or treatment of disease unless expressly authorized by law and separately disclosed in writing.
Educational Guidance Only
The Parties acknowledge and agree that any information, recommendations, suggestions, observations, or other communications provided by the Practitioner to the Client under this Agreement are provided solely for educational and informational purposes and are intended to support general wellness, self-care awareness, and informed decision-making.
The Client understands that the Practitioner is not providing medical advice, diagnosis, prognosis, or treatment, and that nothing in this Agreement or in any communication from the Practitioner shall be construed as a substitute for evaluation, diagnosis, treatment, or advice from a physician, licensed healthcare provider, or other qualified medical professional.
The Client is encouraged to seek prompt medical attention from an appropriate licensed healthcare provider for any symptoms, concerns, or conditions that may require medical evaluation or treatment, including any urgent, severe, or worsening symptoms. The Client remains solely responsible for consulting with appropriate healthcare professionals regarding the Client's health status, medications, diagnoses, and treatment options.
To the extent any recommendation references traditional Chinese medicine, herbal products, supplements, lifestyle practices, or other wellness modalities, the Client acknowledges that such references are provided for general educational purposes only and do not constitute a recommendation by the Practitioner that the Client use any particular product, service, or modality.
Nothing in this Agreement shall be interpreted to limit or waive any rights or protections available to the Client under applicable law, or to require the Client to forego medical care. The Client acknowledges that the Practitioner has made no promise or guarantee of any specific outcome.
Client Consultation with Medical Provider
The Client acknowledges and agrees that the services and any related products provided under this Agreement are wellness-oriented and educational in nature and are not a substitute for medical advice, diagnosis, treatment, or care. The Client shall consult with a qualified medical provider before using the services or products if the Client has, suspects, or develops any symptoms, diagnoses, injuries, pain, adverse reactions, or other medical concerns.
The Client further agrees to consult a qualified medical provider before using the services or products if the Client is:
- taking any prescription or over-the-counter medications, supplements, or herbal products;
- pregnant, trying to conceive, undergoing fertility care, or breastfeeding;
- managing any acute, chronic, complex, or recurring health condition; or
- uncertain whether the services or products are appropriate for the Client's health status.
The Client shall promptly inform the Practitioner of any relevant medical condition, medication, pregnancy, fertility treatment, or other health-related change that may affect the Client's use of the services or products. The Practitioner may, in the Practitioner's sole discretion, decline to provide or continue services, or may require written clearance from a medical provider, if the Practitioner believes consultation or medical supervision is advisable.
Nothing in this Agreement shall be construed as a representation or warranty that the services or products are suitable for the Client's particular medical condition, and the Client remains solely responsible for obtaining appropriate medical advice and for deciding whether to use any service or product. If the Client experiences severe, worsening, or emergency symptoms, the Client shall seek immediate medical attention or emergency services.
Individual Wellness Assessment
The Practitioner may conduct an individual wellness assessment of the Client for the limited purpose of understanding the Client's wellness-related goals, preferences, concerns, and general health and lifestyle context so that the Practitioner may provide wellness-oriented and educational services under this Agreement.
The assessment may be based on one or more consultations with the Client and on information voluntarily provided by the Client, which may include the Client's self-reported symptoms, health history, current wellness practices, stressors, sleep patterns, nutrition, activity level, medications or supplements, and other information the Client elects to disclose.
The Client acknowledges that the assessment is intended to support wellness education and does not constitute a medical diagnosis, treatment plan, or substitute for evaluation by a physician or other licensed health care provider. The Practitioner does not guarantee any particular outcome, and the Client remains responsible for deciding whether to follow any wellness suggestions or educational materials provided by the Practitioner.
If, in the Practitioner's judgment, the Client's information or condition suggests the need for medical evaluation, urgent care, or services outside the Practitioner's scope of practice, the Practitioner may recommend that the Client consult a physician, Traditional Chinese Medicine practitioner, or other appropriate licensed professional, as applicable.
The Client consents to the Practitioner's collection and use of the information provided for the purpose of conducting the assessment and delivering services under this Agreement, subject to any applicable confidentiality obligations and privacy requirements.
Nothing in this clause shall be construed to expand the Practitioner's scope of practice beyond what is permitted under applicable law or to authorize the Practitioner to provide services requiring licensure or authorization that the Practitioner does not hold.
Custom Herbal Formula Preparation
The Practitioner may, based on the Practitioner's professional assessment and within the scope of the services described in this Agreement, prepare or arrange for the preparation of a custom herbal granule formula for the Client. The Client acknowledges and agrees that any such formula is individualized and may be compounded using information obtained through the Practitioner's intake, consultation, observations, and ongoing assessment of the Client's wellness-related needs and goals.
The Client further acknowledges that the custom herbal granule formula may be prepared on a recurring monthly subscription basis, subject to the Client's continued authorization, ongoing assessment, and any applicable payment, shipping, and fulfillment terms set forth in this Agreement or otherwise communicated by the Practitioner.
The Client understands that the Practitioner is a licensed Traditional Chinese Medicine practitioner authorized to provide wellness-oriented services under applicable law, and that any herbal formula preparation provided under this Agreement is offered only to the extent permitted by applicable law and within the Practitioner's lawful scope of practice. The Client is responsible for providing complete and accurate information regarding allergies, sensitivities, medications, supplements, pregnancy or nursing status, medical conditions, and any other information reasonably necessary for safe assessment and preparation of the formula.
The Client acknowledges that herbal products may not be appropriate for every individual and that the Practitioner does not guarantee any particular result. The Client agrees to review all product labels, instructions, and warnings provided with any shipped formula, to use the product only as directed, and to promptly notify the Practitioner of any adverse reaction, concern, or change in health status. The Practitioner may modify, suspend, or discontinue the formula at any time based on the Practitioner's assessment, the Client's reported response, product availability, legal or safety considerations, or any other reasonable basis.
To the extent permitted by applicable law, the Client authorizes the Practitioner and any designated fulfillment or shipping provider to package, label, and deliver the custom herbal granule formula to the Client on an ongoing basis in accordance with the subscription arrangement. The Client may cancel future shipments in accordance with the cancellation procedures set forth in this Agreement or otherwise provided by the Practitioner.
Follow-Up Consultations
The Client may, at the Client's option, schedule follow-up consultations with the Practitioner from time to time for the purpose of reviewing the Client's progress, discussing any questions or concerns, and considering whether any adjustments to the custom herbal granule formula may be appropriate based on the Practitioner's assessment and the Client's reported experience.
Any follow-up consultation shall be subject to the Practitioner's availability and any separate scheduling, fee, cancellation, or rescheduling policies communicated by the Practitioner. The Client understands that follow-up consultations are optional and are not required unless the Practitioner recommends that the Client return for additional review.
During any follow-up consultation, the Practitioner may, in the Practitioner's professional judgment, recommend modifications to the custom herbal granule formula, including changes to the ingredients, dosage, preparation, or shipping schedule, or may recommend that the Client continue the existing formula without change. Any such recommendation shall be informational and shall not constitute a guarantee of any particular outcome.
The Client remains responsible for promptly informing the Practitioner of any changes in health status, symptoms, medications, supplements, allergies, adverse reactions, pregnancy status, or other information that may be relevant to the Practitioner's assessment. The Client acknowledges that failure to provide complete and accurate information may affect the Practitioner's ability to make appropriate recommendations.
Nothing in this Section requires the Practitioner to provide ongoing monitoring, emergency services, or medical care, and the Client should seek appropriate medical attention from a licensed healthcare provider for any urgent, severe, or worsening condition.
Limitations and Client Responsibility
The Client acknowledges and agrees that the Practitioner's services are limited to wellness-oriented and educational support and are not a substitute for medical diagnosis, treatment, emergency care, or other services provided by a physician, emergency medical provider, or other licensed healthcare professional.
The Client is solely responsible for providing complete, accurate, and current information regarding the Client's health history, symptoms, medications, supplements, allergies, diagnoses, laboratory results, pregnancy or breastfeeding status, and any other information reasonably requested by the Practitioner or otherwise relevant to the services.
The Client further agrees that if the Client experiences chest pain, difficulty breathing, severe allergic reaction, fainting, suicidal thoughts, uncontrolled bleeding, severe pain, high fever, sudden weakness, confusion, stroke-like symptoms, or any other urgent, serious, or rapidly worsening symptom, the Client will immediately seek emergency medical attention by calling 911 or local emergency services, or by going to the nearest emergency department, and will not rely on the Practitioner for emergency care.
Nothing in this Agreement prevents the Client from seeking care from other healthcare providers, and the Client is encouraged to consult a physician or other appropriate licensed healthcare professional regarding any medical condition, medication, or urgent concern.
Acknowledgment and Consent
The Client acknowledges and agrees that the Practitioner is providing wellness-oriented and educational services only, and not medical diagnosis, treatment, or care unless expressly authorized in writing and by applicable law. The Client understands that the Practitioner's services are intended to support general wellness and education, and are not a substitute for consultation with a physician, licensed health care provider, or other qualified professional regarding any medical condition, symptom, diagnosis, or treatment decision.
The Client further acknowledges that the scope of the Practitioner's services may include review of the Client's self-reported information, wellness guidance, and, where applicable, preparation or facilitation of a custom herbal granule formula on a monthly subscription basis.
The Client confirms that the Client has had the opportunity to ask questions regarding the nature, scope, and limitations of the services, and that all questions have been answered to the Client's satisfaction. The Client understands that the Client may discontinue services at any time, subject to the terms of this Agreement, and that the Practitioner may modify, suspend, or decline to provide services if the Practitioner determines that the Client's needs are outside the scope of the Practitioner's services or otherwise inappropriate for continued service.
The Client acknowledges that the Client has disclosed, and will continue to disclose, complete and accurate information relevant to the services, including any known allergies, sensitivities, medications, supplements, medical conditions, pregnancy or nursing status, and any other information reasonably requested by the Practitioner.
By proceeding, the Client knowingly and voluntarily consents to receive the services described in this Agreement on the basis set forth herein, and acknowledges that the Client understands and accepts the scope and limitations of the Practitioner's services.
